Pedestrian accidents rise

Pedestrians find themselves at risk in Maryland and throughout the United States. Anyone walking near or crossing a street in the state remains in proximity to moving vehicles, placing them potentially in harm’s way. Pedestrian accident statistics raise concerns because the fatality rates are high.

Pedestrian accident statistics

A study performed by Smart Growth America reveals that an average of 18 pedestrians die every day, with the total figure from 2021 reaching 7,265 deaths. The figure reflects an increase of 4.7% from 2020. Little indicates those numbers will decrease in coming years, so more steps might be necessary to raise awareness about the dangers to pedestrians.

Numerous factors contribute to motor vehicle and pedestrian accidents. Increased vehicle technology, such as infotainment systems, plays a role in distracting drivers. Traditional reckless behaviors, including speeding and making illegal turns, contribute to accidents.

Some roads might be more dangerous than others. Persons walking along busy highways on narrow shoulders could find themselves at significant risk. A driver who drifts into the shoulder may hit someone.

Legal matters

Investigations of pedestrian accidents might focus on determining who is at fault. Often, driver negligence led to the accident, leaving the driver open to a civil lawsuit. With fatal accidents, survivors might file a wrongful death lawsuit.

Drivers may have a claim against pedestrians in some instances. If an intoxicated pedestrian darts into the road, the driver might sue the pedestrian since the fault may rest on the pedestrian’s shoulders.

When the driver’s behavior caused the accident, the victims could seek compensation by filing a liability claim. Auto or uninsured motorist policy coverage may provide a settlement to victims. However, some cases could still go to court.
